Appellate Practice
When a trial judge or jury renders a decision in a civil or criminal trial, the party who loses his case has the right to appeal the decision. Many commercial and civil disputes as well as criminal cases that result in litigation frequently go on to the appeals process.
Appellate law involves the appeals process whereby a higher court reviews the lower court’s judgment. Unlike other forms of litigation, in appellate law there is no discovery; the appellate record is limited to the facts presented during the original trial. In New Jersey, appeals are presented to a two or three judge appellate panel.
Because appeals are decided almost entirely on the written briefs, a compelling appellate brief and a powerful oral argument are the vital basis of a successful legal advocate’s appeal.
Along with broad-based litigation capability, the Law Offices of Alan L. Zegas located in Chatham, New Jersey, maintain a significant appellate practice. Many years of experience enable Mr. Zegas to blend the factors essential in preparation of an appeal, which include thorough legal research, an astute analysis of the appellate problem and familiarity with both the appellate judges and the appellate courts as well as in-depth understanding of appellate procedure and appellate motion practice.
With extensive experience both as a trial lawyer and in appellate law, Mr. Zegas also provides litigation support for other attorneys who require appellate expertise and counsel on procedural issues before trial, during trial, and in preparation for possible appeal.
